Overview
Kit & Steel is a peer-to-peer marketplace that connects independent sellers with buyers. Kit & Steel does not warehouse, handle, ship, or take possession of any products listed on the platform. All transactions occur directly between individual sellers and buyers. By using Kit & Steel, you acknowledge and agree to the terms of this Shipping Policy.
No Liability for Shipping
KIT & STEEL IS NOT A PARTY TO ANY SHIPPING TRANSACTION AND ASSUMES NO LIABILITY WHATSOEVER FOR ANY LOSS, DAMAGE, DELAY, MISDELIVERY, OR FAILURE TO DELIVER ARISING FROM OR RELATED TO THE SHIPMENT OF ANY ITEM. This includes, but is not limited to, items lost in transit, items damaged during shipping, delivery delays, incorrect delivery, or theft. Kit & Steel expressly disclaims any and all liability in connection with the shipment of goods between buyers and sellers on its platform, to the fullest extent permitted by applicable law.
All shipping-related disputes are solely between the buyer, seller, and the shipping carrier. Kit & Steel will not be responsible for resolving shipping claims or compensating any party for shipping-related losses.
Seller Shipping Responsibilities
Sellers are solely and entirely responsible for all aspects of shipping, including:
- Packaging items securely and appropriately for safe transport
- Shipping within their stated handling time
- Selecting a reputable carrier and appropriate shipping method
- Providing accurate and timely tracking information to the buyer
- Ensuring items are legal to ship under all applicable federal, state, and local laws in both the origin and destination jurisdiction
- Complying with all carrier policies, restrictions, and requirements
- Purchasing shipping insurance if desired — Kit & Steel does not provide or require shipping insurance and assumes no liability for uninsured shipments
- Accurately representing the item’s condition, dimensions, and weight for shipping purposes
Failure to meet these responsibilities may result in account suspension or removal from the platform. Kit & Steel reserves the right to take action against sellers who repeatedly fail to fulfill their shipping obligations, but is under no obligation to do so and assumes no liability for a seller’s failure to ship.
Buyer Acknowledgments
By purchasing on Kit & Steel, buyers acknowledge and agree that:
- Shipping times vary by seller and are estimates only — Kit & Steel makes no guarantees regarding delivery timeframes
- Estimated handling and shipping times are listed on each product page and are provided by sellers, not Kit & Steel
- Buyers are responsible for reviewing a seller’s shipping details, policies, and handling times before completing a purchase
- Tracking information will be provided by the seller once the item ships — Kit & Steel has no control over and accepts no responsibility for tracking accuracy
- Kit & Steel is not responsible for any customs, duties, taxes, or import fees associated with shipments
- Kit & Steel is not responsible for shipping delays caused by carriers, weather, natural disasters, or other circumstances beyond the seller’s control
Shipping Carriers
Sellers may use any reputable carrier, including USPS, UPS, FedEx, or similar services. Certain items may have carrier restrictions — it is the seller’s sole responsibility to comply with all carrier policies. Kit & Steel makes no representations or warranties regarding the reliability, service quality, or policies of any shipping carrier, and is not liable for any carrier errors, failures, or delays.
Damaged or Lost Shipments
If your item arrives damaged or is lost in transit, please follow the steps below. Note that Kit & Steel’s ability to assist is limited, and resolution is ultimately the responsibility of the seller and/or the shipping carrier:
- Document the damage with clear photos immediately upon receipt
- Contact the seller directly through your account dashboard
- If the seller is unresponsive or the issue remains unresolved after a reasonable period, contact Kit & Steel through our Contact page — we will attempt to facilitate communication but are not obligated to provide refunds or compensation
- Do not confirm delivery in GunTab until the issue is resolved
IMPORTANT: Kit & Steel does not guarantee any particular outcome for damaged or lost shipment claims. Any assistance provided by Kit & Steel is offered as a courtesy only and does not constitute an admission of liability or an obligation to resolve the dispute.
Interstate Shipping & Legal Compliance
All sellers are solely responsible for ensuring their shipments comply with all applicable federal, state, and local laws and regulations, including but not limited to laws governing the sale and transport of firearms accessories, ammunition, and related products. Kit & Steel does not provide legal advice and makes no representations regarding the legality of any transaction or shipment. When in doubt, consult a licensed attorney familiar with firearms accessory regulations in your jurisdiction.
Kit & Steel expressly disclaims any liability arising from a seller’s non-compliance with applicable laws governing shipments, including any fines, penalties, confiscation, or legal action resulting from an unlawful shipment.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIT & STEEL, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ANY SHIPMENT, INCLUDING BUT NOT LIMITED TO LOSS OF GOODS, LOSS OF REVENUE, OR PHYSICAL DAMAGE TO PROPERTY, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE), EVEN IF KIT & STEEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Changes to This Policy
Kit & Steel reserves the right to modify this Shipping Policy at any time without prior notice. Continued use of the platform following any changes constitutes acceptance of the revised policy. We encourage users to review this policy periodically.
