1. About Kit & Steel
Kit & Steel LLC (“Kit & Steel,” “we,” “our,” or “us”) operates an online marketplace at kitandsteel.com where registered sellers can list tactical gear, gun accessories, and EDC equipment for sale to registered buyers. Kit & Steel is a platform and is not a party to transactions between buyers and sellers unless explicitly stated.
2. Eligibility
You must be at least 18 years of age to create an account or use the marketplace. By using Kit & Steel, you represent and warrant that you meet this age requirement and that you are legally permitted under all applicable federal, state, and local laws to purchase, possess, or sell the items you transact in on the platform.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update that information as necessary. Kit & Steel reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, deceptive, or harmful behavior.
4. Seller Obligations
By listing an item for sale on Kit & Steel, you agree to the following:
-You are the lawful owner of the item or have authorization to sell it.
-Your listing is accurate, truthful, and not misleading.
-The item complies with all applicable federal, state, and local laws, including but not limited to laws governing the sale of firearms accessories and tactical equipment.
-You will ship items promptly upon confirmed payment and provide tracking information.
-You will not list prohibited items as defined in Section 6 of these Terms.
-You understand that Kit & Steel charges a 5% commission on completed sales, deducted automatically at the time of payout.
5. Buyer Obligations
By purchasing an item on Kit & Steel, you agree to the following:
-You are legally permitted to purchase and possess the item in your jurisdiction.
-You will complete payment through GunTab as directed at checkout.
-You will confirm receipt of your order in GunTab in a timely manner once the item has been received and inspected.
-You will not misuse the dispute process or make false claims against sellers.
6. Prohibited Items and Conduct
The following items and conduct are strictly prohibited on Kit & Steel:
-NFA items (machine guns manufactured after 1986, unlicensed suppressors, short-barreled rifles/shotguns without proper registration, etc.)
-Items that are illegal under federal, state, or local law
-Stolen property
-Counterfeit or materially misrepresented items.
-Items subject to active export controls or sanctions
-Firearms of any kind including handguns, rifles, and shotguns
-Ammunition of any kind
-Harassment, threats, or abusive conduct toward other users
-Attempting to circumvent the GunTab payment system or conduct off-platform transactions to avoid fees
-Creating fake reviews or otherwise manipulating the platform’s reputation system
Kit & Steel reserves the right to remove any listing and suspend or terminate any account that violates this section, at our sole discretion, with or without notice.
7. Payments and Fees
All transactions on Kit & Steel are processed through GunTab, our third-party payment processor. By using Kit & Steel, you also agree to GunTab’s terms of service and privacy policy, available at guntab.com. Kit & Steel is not responsible for payment disputes, errors, or failures that occur within GunTab’s platform.
Kit & Steel charges sellers a 5% commission on completed sales. There are no listing fees, monthly subscription fees, or penalty fees. The commission is automatically deducted from the seller’s payout at the time of release from GunTab escrow.
8. Escrow and Dispute Resolution
Buyer payments are held in escrow by GunTab until the buyer confirms receipt of the item. If a dispute arises, the buyer must not confirm delivery and must contact GunTab directly at guntab.com to initiate their dispute resolution process. For platform related issues that cannot be resolved through GunTab, contact Kit & Steel at mike@kitandsteel.com. Kit & Steel will review platform related disputes and work with both parties to reach a fair resolution. Kit & Steel’s determination of platform disputes is final.
Kit & Steel is not liable for losses arising from buyer or seller fraud, misrepresentation, shipping damage, or GunTab system failures, except to the extent required by applicable law.
9. Shipping and Delivery
Sellers are solely responsible for packaging, shipping, and delivering items to buyers. Kit & Steel does not handle, inspect, or take possession of any items. Sellers must ship items within the handling time stated in their listing. Failure to ship in a timely manner may result in account suspension.
10. Harassment and Conduct Policy
Kit & Steel is built on community trust. All users — buyers and sellers alike — are expected to conduct themselves with professionalism and respect at all times.
The following conduct is strictly prohibited and will result in immediate account suspension or permanent termination:
-Harassment, threats, or intimidation of any user in any form
-Hate speech, discriminatory language, or personal attacks
-Sending unsolicited or inappropriate messages to other users
-Attempting to conduct transactions outside the Kit & Steel platform to circumvent fees or protections
-Fraudulent listings, misrepresentation of items, or deceptive pricing
-Creating multiple accounts to evade suspension or bans
-Any conduct that Kit & Steel, in its sole discretion, determines to be harmful to the community
Kit & Steel LLC reserves the right to remove any content, suspend any account, or permanently ban any user at any time and without prior notice for violations of this policy. No refunds of fees will be issued upon termination for cause.
11. Refund Policy
Kit & Steel facilitates transactions between independent buyers and sellers. All payments are processed through GunTab. Kit & Steel LLC does not issue refunds for transaction fees on completed sales. All refund and dispute resolution for payments is handled exclusively through GunTab’s escrow and dispute process at guntab.com. Kit & Steel LLC is not a party to any transaction and assumes no liability for failed, fraudulent, or disputed transactions.
12. Law Enforcement and Legal Inquiries
Kit & Steel LLC cooperates fully with legitimate law enforcement requests and legal processes including subpoenas, court orders, and lawful governmental requests.

Kit & Steel LLC will respond to all verified legal requests in accordance with applicable federal and state law. We reserve the right to notify affected users of legal requests unless prohibited by law from doing so. Kit & Steel LLC reserves the right to report suspicious activity, fraudulent transactions, or illegal conduct to appropriate law enforcement authorities at our sole discretion.
13. Intellectual Property
All content on the Kit & Steel website, including logos, text, design, and software, is owned by Kit & Steel LLC or licensed to us and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission. By posting listings or other content on Kit & Steel, you grant Kit & Steel a non-exclusive, royalty-free license to display and use that content in connection with operating the marketplace.
14. Disclaimer of Warranties
Kit & Steel is provided “as is” and “as available” without any warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or harmful components. We make no representations about the accuracy, legality, or quality of any listing or item sold on the platform.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Kit & Steel LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to lost profits, data loss, or personal injury, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of Kit & Steel shall not exceed the fees paid by you to Kit & Steel in the three months preceding the claim.
16. Indemnification
You agree to indemnify, defend, and hold harmless Kit & Steel LLC and its members, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the platform; (b) your listings or transactions; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Mississippi, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
18. Modifications to These Terms
Kit & Steel reserves the right to modify these Terms at any time. We will post the updated Terms on this page with a new effective date. Your continued use of the platform after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
